The Nigerian Bar Association yesterday commended the erudite judgement of Justice Adeniyi Ademola of the Federal High Court sitting in Abuja on the financial autonomy of the Nigerian Judiciary, in respect of the administration of its funds, in accordance with the provisions of the 1999 constitution of the Federal Republic of Nigeria.
The president of NBA Mr. Okey Wali SAN, in a press statement said that It is important to note that the case was about the practice of the
executive disbursing funds to the judiciary, a practice the NBA has not
only repeatedly stated was unconstitutional, but also viewed as
threatening the independence of the judiciary.
The NBA president said that the provisions of
Sections 83(1);212(3) and 162(9) of the 1999 constitution are crystal
clear in respect of funding of the judiciary, and hereby calls on all
parties to comply with the judgment and orders of the Honourable Court,
with a view to implementing the constitutional provisions for the
financial autonomy of the judiciary, thereby ensuring the independence
of the judiciary and rule of law.
