INEC says only an election tribunal can cancel the Anambra Governorship Election

INEC has declared that with the declaration of election results by the returning officer of the Anambra Governorship elections, there is no way the election so far conducted can be cancelled, pointing out that only the election tribunal has the power to cancel an election after the results have been declared.

The returning officer of the governorship election is the Vice Chancellor of the University of Calabar, Prof. James Epoke who stated that the elections in parts of the state

because the difference in the figures between the first two candidates, which is 79,754 is less than the cancelled votes, which 113,113, the commission could not declare anybody the winner.
A total of 1,763,751 voters were registered for the election, while 451,826 were accredited.
Total valid votes was 413,005, while total number of rejected votes was 16,544. Total votes cast was 429,549.

Spokesman to the INEC Chairman, Mr Kayode Idowu stated that those calling for the cancellation of the election cannot have their wishes granted because the commission is not empowered by law to cancel election after the results have been formally declared by the returning officer.

He stated that the returning officer made the declaration on the basis of results presented to him by field officers.

According to the INEC spokesman: “The calls will come no doubt; but one thing we should take into account is the fact that there is law in whatever we do. There are laws governing or guiding all activities of INEC; the election in Anambra is not isolated.

“For now, even though it is difficult for me to state when the election will hold, one thing I can assure you is that the INEC chairman has summoned all field officers to Abuja with a view to interrogating their reports on the election.”

On whether Jega was under pressure to cancel the election and conduct a fresh one, Idowu said: “It depends on what you mean by pressures; if you call the suggestions in some quarters pressures, fine and good; but, like I said earlier, such calls are immaterial because once the returning officer makes a pronouncement on any election result, it stands. Not even Prof. Jega has powers to cancel such; only the election petitions tribunal can make a pronouncement on the conduct of any election.”

The local government areas are Ayamelu, Anambra West, Anambra East, Idemili South, Nnewi South, Oyi, Orumba North, Onitsha North, Ekwusigo, Aguata, and Awka North.
